FORTAFENCE – TERMS & CONDITIONS

Victoria, Australia — Effective 9 March 2026 1. Services and Eligibility 1.1 We repair leaning fences by straightening timber posts and reinforcing them at ground level using a deep‑driven steel support. We do not rebuild or replace full fences. 1.2 Eligible posts are timber around 70–75 mm that are failing at or near ground level. 1.3 You agree to provide clear photos so we can assess suitability and prepare an estimate. 1.4 Authority: You confirm you are authorised to approve the works at the property, including (if relevant) authority from co‑owners, the legal owner, an owners corporation/body corporate, a managing agent, an insurer, and/or an adjoining neighbour for boundary fencing. 2. Pricing, Quotes and Variations 2.1 Advertised pricing is indicative only. Final price depends on various factors including ground conditions, access, alignment required, and number of posts. 2.2 Written quotes are valid for 30 days. 2.3 If site conditions differ from what was disclosed or shown in photos (for example, restricted access or unexpected complexity), we will advise any price change before continuing. 3. Scheduling and Access 3.1 Dates are indicative and may change due to weather, workload or site conditions. 3.2 Unless otherwise agreed in writing, you will provide us with: (a) clear and safe access to the leaning section and post bases, secure pets, and remove obstacles; (b) a working power point within 25 m; and (c) access to and authorised use of any nearby anchor points such as trees, posts or solid structures that may assist with straightening. 4. Site Conditions and Underground Services 4.1 Fence straightening performance depends on soil strength and stability; results vary with ground conditions. 4.2 You are responsible for identifying or marking underground services and concealed hazards. We are not liable for damage to undisclosed services. 5. Inclusions and Exclusions 5.1 Included: straightening of leaning post(s) and installation of reinforcement unit(s) as agreed. 5.2 Not included: fence replacement, new rails or palings, painting, or timber repairs beyond the reinforced post(s) unless otherwise agreed in writing. 6. Payment 6.1 Unless otherwise agreed in writing, payment is due upon completion of the works. A deposit may be required prior to works commencing. 6.2 Invoices are deemed accepted unless disputed in writing within 3 days of issue. Any undisputed portion must be paid on time. 6.3 If payment is not received by the due date, we may: (a) suspend or defer further work; (b) charge late fees and costs under clause 7; and/or (c) take debt recovery action. 6.4 You must not set‑off or withhold payment for any reason other than a bona fide dispute notified under 6.2. 7. Late Fees and Debt Recovery 7.1 Interest accrues on overdue amounts at 10% per annum, calculated daily from the due date until paid in full. 7.2 A reasonable monthly administration fee may be charged on overdue accounts to cover additional handling. 7.3 You are liable for all reasonable costs we incur in recovering overdue amounts, including debt‑collection fees, legal costs on an indemnity/solicitor‑client basis, and court filing/enforcement fees. 7.4 We may apply payments received to any amounts outstanding at our discretion. 8. Warranty 8.1 Materials and workmanship are covered under the Fortafence Limited Warranty (3 years), subject to the conditions and limitations stated therein. 8.2 Your rights under the Australian Consumer Law remain unaffected. 9. Liability 9.1 To the maximum extent permitted by law, our liability is limited to re‑supply or the cost of re‑supply of the service. 9.2 We are not liable for indirect or consequential loss. 9.3 Nothing limits your rights under the Australian Consumer Law. 10. Cancellation 10.1 If you cancel after accepting a quote, we may charge for time booked, materials purchased and reasonable costs incurred. 10.2 We may postpone or cancel works where the site is unsafe or unsuitable. 11. Disputes 11.1 Please raise any issues promptly so we can resolve them. Both parties will make reasonable efforts to settle disputes before external action unless required by law. 12. Governing Law 12.1 These Terms are governed by the laws of Victoria, Australia.

WARRANTY

1. What is Covered 1.1 Defects in the steel reinforcement support supplied. 1.2 Defects in our installation workmanship at your property. 2. Warranty Period and Remedy 2.1 The warranty is 3 years from the installation date. 2.2 Our remedy is, at our option, repair or replacement of the affected support. This is the full extent of the warranty. 3. Conditions 3.1 Installation must be carried out by Fortafence or our authorised installer. 3.2 The support must be driven to full embedment with the wings fully below ground level. 3.3 The fence must be kept in reasonable condition. 3.4 All amounts owing must be paid in full. 4. Exclusions 4.1 Soil‑related limits including reduced performance from soft, loose, unstable, eroded or subsiding ground. 4.2 Rot, decay or failure of timber posts, rails or palings above or below ground. 4.3 Extreme weather, storm events, impact, collision, alteration or work by others. 4.4 Pre‑existing structural defects in the fence. 5. Australian Consumer Law and Limits 5.1 To the maximum extent permitted by law, liability is limited to repair or replacement of the affected support; indirect or consequential losses are excluded. 5.2 Nothing in this warranty limits your Australian Consumer Law rights. 5.3 The warranty applies to the original customer and is not transferable. Victoria jurisdiction. 6. How to Claim 6.1 Email details and clear photos of the issue to info@fortafence.com.au. We may require an on‑site inspection. If covered, we will arrange repair or replacement.

Security and Retention 5.1 We take reasonable steps to protect information. 5.2 We keep it only as long as needed for quotes, jobs, warranty, and legal or business requirements, then delete or de‑identify it. 6.
